Personal Artistic Video Content: Non-Distribution Policy

This document outlines the strict rules governing the creation, storage, and non-distribution of specific artistic

video content produced by Gerardo C Ibarra aka Kemelyen -Kemelyen Ltd. (the “Creator”).

1. Purpose and Intent

The content governed by this policy consists of unique, original artistic animated videos created solely for

private viewing. This content is not intended for commercial use, or general distribution. Unauthorised

distribution constitutes a serious breach of this agreement and is a violation of copyright law, which protects

original artistic works.

2. Definition of “Content”

“Content” refers exclusively to specific digital assets designated by the Creator, typically marked with internal

identifiers or metadata indicating their sensitive, non-distributable status.

3. Strict Non-Distribution Clauses

A. Prohibition of Sharing:

No person, including collaborators, temporary assistants, or close contacts, may upload, email, privately

message, post on social media, share via cloud storage, or otherwise transmit the designated Content to any

external party without the Creator’s explicit, written permission for each specific instance of sharing.

B. Scope of Use:

Use is restricted to internal, private use.

C. No Derivatives/Modification:

No part of the Content (including still frames, sketches, or sound assets) may be copied, modified, adapted, or

incorporated into any works without explicit permission.

4. Security and Storage Protocols

Individuals granted temporary access to the Content are responsible for maintaining its security:

• Secure Storage: The Content must be stored on its original drive, which may be encrypted/password

protected.

• One device use: The artistic content stored on this drive is solely limited to be installed on only one device.

• Data Minimisation: No copies of the Content should be made unless necessary for the immediate workflow,

and all temporary copies must be securely deleted once the task is complete.

5. Consequences of Breach and Legal Ramifications

A breach of this policy is a violation of the trust and copyright established by the Creator.

• Civil Action: The Creator maintains the right to pursue full civil legal action to recover damages caused by

unauthorised distribution, including loss of creative control, reputational harm, and financial damages.

• Criminal Charges (Copyright Infringement): Since this content is protected intellectual property,

unauthorized reproduction or distribution can constitute copyright infringement, which may be pursued

under the applicable criminal statutes of the corresponding countries.

Any person violating this policy will be held fully liable for any legal fees and financial penalties incurred.

6. Acknowledgment

By accessing, viewing, or handling the Content, you acknowledge that you have read, understood, and agree

to adhere strictly to this Non-Distribution Policy.
